California Car Accident Death Linked To Distracted Driving

The recent tragic car accident involving a California woman underscores the dangers of distracted driving. Sacramento news reports that a 22-year-old woman was driving Saturday when her car went off the road at a high speed and crashed into a utility pole. Reports indicate that “cell-phone distraction” may have been a factor in the crash because a call was taking place at the time of the accident. The woman was pronounced dead at the scene.

Despite significant efforts to reduce the incidence of distracted driving – including California’s hands free law – a majority of Californians admit to engaging in distracted driving. In fact, A University of San Diego study revealed that 78% of college students admitted to using a phone while driving.

Further, Reports indicate that in April’s distracted driving sweep by law agencies across California resulted in 57,000 electronic distracted driving tickets. Another 3,800 were written for general distracted driving, the Office of Traffic Safety reported May 16.

Last week Senate Bill 1310 was approved, increasing fines by $30 to $251 for a first offense, and $60 to $372 for each subsequent offense.

Under current law:

• Adult drivers (18 and older) may only use hands-free devices.

• Drivers are prohibited from sending text messages.

• Minors are prohibited from using wireless phones while driving — with or without hands-free accessories.

• School bus operators and transit bus drivers prohibited from using cell phones while driving.

Pedestrian Accident Leads To Safety Questions

A recent pedestrian accident has raised questions of safety. Pedro Velez-Hernandez was walking in a bicycle lane when he was struck by a vehicle that veered into the bike lane.

As a result of the accident, neighbors and residents raised concerns that the lack of sidewalks and fast traffic led to this death. While many times, accidents may just “happen” other times several causes lead to a serious personal injury or wrongful death. If you have or a loved one has been injured in an accident, it is important to contact a top Stockton accident lawyer to evaluate your rights and determine your next steps.

In some situations, “negligent roadway design” may be considered a factor in an accident, and in these cases, a municipality or other entity responsible for designing the particular thoroughfare may be found liable for accidents that occur. Negligent roadway design includes things such as poorly lit street, inadequate signage, and sometimes, the lack of sidewalks to accommodate foot traffic.

News reports note:

“Nationally, there are more than twice as many pedestrian fatalities in roadways and thoroughfares without sidewalks.”

Further, the California Vehicle Code prohibits pedestrians from using bicycle paths “where there is an adjacent adequate pedestrian facility,” in a code adjustment passed in 1977. But the code allows pedestrians to use roads and bicycle lanes when there’s no sidewalk – and, therefore, no other options.”

Here, the accident remains under investigation.

Teenager Killed In Bicycle v. Car Accident

Stockton news reports that a California teenager was killed in a bicycle v. vehicle accident this past week. Unfortunately, the incidence of California pedestrian accidents remains high, with two California cities – San Francisco and Los Angeles – having some of the highest rates of pedestrian v. vehicle and bicycle v. vehicle accidents in the country. According to the University of Michigan Transportation Research Institute, pedestrian traffic fatalities in Los Angeles are nearly triple the national average.

Further, National Public Radio (NPR) reveals that in 2012, the LAPD recorded more than 2,500 motor vehicle vs. pedestrian incidents.

If you have been injured in any type of roadway accident, including a pedestrian accident or bicycle accident, it is important to contact an experienced Stockton personal injury lawyer right away. A knowledgeable Stockton accident lawyer can begin an investigation into all of the factors that may have caused or contributed to an injury accident and ensure you receive all the compensation you deserve.

Common injuries in pedestrian accidents.

Where pedestrian v. automobile or bicycle v. automobile accidents occur, the potential for serious injury is great.

Common injuries include:

• Traumatic brain injuries
• Spinal cord injuries
• Broken bones
•Cuts and bruises

And in the worst-case scenario, death.

An experienced personal injury lawyer can help you or your family recover compensation for your injuries.

Causes of Pedestrian and Bicycle Accidents

Pedestrian and bicycle accidents occur for a variety of reasons. In some situations, a pedestrian or bicyclist may be partially responsible for an accident, such as if he or she does not have the right of way or fails to pay attention before entering the roadway (listening to music, walking and texting or biking and texting can be dangerous when it distracts you from paying attention to your surroundings.)

Other times, the driver of the automobile may be at fault. This includes drunk driving accidents, distracted driving accidents and other situations where the driver of a vehicle drives recklessly or negligently, resulting in an accident. Like many cities across the country, including Stockton, Sacramento and San Francisco, L.A. drivers and pedestrians are increasingly distracted by electronic devices. For many Californians’ the problem is exacerbated due to the amount of time California drivers spend in their cars, commuting back and forth.

It’s also always important to evaluate a potential third factor in the cause of an accident – the roadway itself. Was it adequately maintained? Was the lighting sufficient? Did any obstructions exist making it hard for drivers to see pedestrians or bikers?

Many questions arise in any accident, so it is always a good idea to consult with a top Stockton personal injury lawyer right away to answer your injury accident questions.

While the Stockton bike accident remains under investigation, it serves as a tragic reminder to everyone – from bikers to walkers to drivers – pay attention and share the road!

Two Redwood City Residents Killed In Drunk Driving Accident

Yolo County news reports that a Redwood City woman and teenager have been killed in a drunk driving car accident. According to reports, the two were killed when a truck they were riding in veered off the highway near Woodland and crashed into a tree. Initial investigations indicate that the truck had been traveling west when it left the roadway, overturned several times and crashed into a tree nearly 75 feet down an embankment. The two were pronounced dead at the scene.

The driver of the truck suffered severe injuries and remains hospitalized. It is unknown the connection between the driver and the victims. He has been arrested for two counts of DUI causing injury or death and could face additional criminal charges.

Whenever a drunk driving accident occurs, in addition to criminal penalties, drivers may face civil charges as well. Injury victims and their families may file a personal injury lawsuit for negligence or wrongful death. A wrongful death lawsuit is similar to a personal injury claim, but is filed by the surviving family members such as a child, spouse or parent. If you have been injured in a drunk driving accident or lost a loved one pursuant to a DUI crash, it is important to seek the advice of an experienced Stockton personal injury lawyer right away.

Unfortunately despite significant attention paid to the dangers of drunk driving, driver intoxication remains one of the leading causes of California auto accidents. Mother Against Drunk Driving (MADD) reports that one person dies every 30 minutes as the result of driver intoxication.

Victims of negligent drunk driving face significant expenses such as medical bills, lost wages, as well as physical and emotional pain and loss of enjoyment of life. Family members who lose loved ones may be torn apart without warning.

Typical injuries include head and neck injuries, brain injuries and spinal cord injuries.

While filing a lawsuit may the furthest thing from your mind if you have been injured or lost a loved one – it is very important to speak to a knowledgeable accident lawyer who can begin an investigation into just what happened and preserve your rights for the future. Because memories fade and as time passes, it may be more difficult to piece together what may have happened during any accident. Having an attorney represent you and take care to preserve evidence right away becomes crucial as time passes.

Stockton Police Officer Killed In Rear End Car Accident

Colleagues, family and friends are grieving the tragic death of Kimberly Pinto, a Stockton Unified School District police officer. She died following a Lodi area car accident. Reports indicate that she was traveling southbound on Highway 99 near Kettleman Road at 5:45 a.m. when the two-vehicle accident occurred. Pinto’s car – a Honda Accord – collided with another vehicle and veered off the highway, striking a eucalyptus tree. The other vehicle in the rear-end crash spun out of control, but the driver was not injured. The driver told CBS13 news “She hit me from behind and we started spinning out.”

Pinto was well respected in the Stockton police department, in a statement issued by the SUSD Police Department, the Police Chief noted “A natural and talented leader, Kim had all the attributes to be chief one day. Kim brought humor, drive, and competence to everything she undertook. She will be deeply missed both personally and professional by all who knew her.”

The accident remains under investigation, although no charges are likely to follow.

Millions of car accidents occur each year across the United States, leading to thousands of serious personal injuries and deaths. According to the most recent National Highway Transportation Safety Administration (NHTSA) California ranks number one with the highest number of car accidents. Although many factors can cause a car crash, the crowded highways and long commutes Californian’s face each day increases their chance of being in a car accident at least once in their lifetime.

Types Of California Car Accidents

Not all car crashes are created equal. The kind of car accident you are in – whether a sideswipe, head-on or rear-end collision – often dictates the type and extent of injuries you are likely to sustain.

Although rear-end accidents may be less likely to result in serious personal injury than head-on collisions, as this accident demonstrates any type of car accident can lead to tragedy based on the circumstances surrounding a crash. For example, dangerous weather conditions or the design of a roadway may make serious injuries more likely. Further drivers commonly find themselves “rear-ended” where traffic is congested or when drivers have to stop unexpectedly. Because rear-impact crashes happen fairly frequently, the likelihood that significant injuries may occur is increased. If you or a loved one has been injured in any type of car accident, it’s a good idea to consult with an experienced Stockton car accident lawyer right away.

If you’ve been rear-ended, it’s also a good idea to keep in mind a couple of suggestions concerning what to do if you’ve been in a car accident. In the most serious accidents, many of these steps may not be possible.

First and foremost – it’s imperative to seek medical attention for you or anyone who may have been involved in the car accident. Once everyone has received the care needed, then you can begin the process of collecting general information. This includes the names, phone numbers and drivers license numbers of the drivers involved in an incident. It is also a good idea to get the names and phone numbers of passengers or other witnesses. You may also want to jot down any impressions you have about how the accident occurred, such as how fast the vehicles were traveling, the conditions of the roadway, any weather conditions, the time of day and any other detail you recall about the circumstances surrounding an incident. Even if you don’t think an issue is important, it may be turn out to be a crucial part in reconstructing how an accident occurred.

Damages may include medical expenses, pain and suffering, lost wages and emotional distress.

Questions Raised Concerning Uber’s Liability In Car Accident That Injured Pedestrian

According to California news, a black Lincoln Town Car collided with a Dodge Charger on Divisadero Street in California. Following the collision, the Charger flew through the intersection, knocking into a fire hydrant. The fire hydrant was then dislodged, flying into the air and striking a pedestrian.

The injured pedestrian has filed a personal injury lawsuit – alleging negligence against not only the drivers of the vehicles but also against the transportation tech company Uber. Uber works by connecting passengers with drivers of luxury vehicles for hire. Despite Uber’s claims that it is not a “transportation provider” – this accident raises questions concerning

Just what does happen if you’re an Uber passenger in the middle of an accident? If you have been injured in any type of automobile accident, it is a good idea to speak to a top Stockton accident lawyer right away.

Here the “car-sharing” arrangement set up by Uber creates many questions concerning liability. For example, is Uber covered by private car insurance or by commercial policies that insure a car for commercial purposes? Commercial policies are in effect in those situations where a car is specifically used for a business – such as a car for pizza delivery company. However where Uber is involved, the company doesn’t actually own any of the cars. Uber contends that they have created primarily technology platforms, modern-day phone books that connect people who already have cars (or car services) to people who want to ride in them and, as a result, are not responsible when injuries occur.

However, representatives for the woman disagree noting “for somebody who uses Uber when you log into that app, it doesn’t say ‘We’re going to help you find an independent transportation company.’ It’s saying ‘Here’s an Uber driver. ..Nothing about that relationship makes you think it’s a mere phone book.”

Uber and other “newfangled cab companies,” create risk – by putting passengers into moving cars in busy urban traffic – in precisely the same way that taxi companies create risk. But they’re not taking any responsibility for it.

Things to do after a car crash.

1. First of all, try to not panic. In that type of a situation, cooler heads prevail, and the more you’re able to deal with the situation, I think the better off you’ll be.

2. Secondly, ensure the safety of yourself and others. In California, if you’re driving down the freeway, there are signs there that say if you’re involved in a minor fender-bender, please move to the side of the freeway. And that’s good advice. It it’s situation where your vehicle is drivable, if you can move it, I would move it out of harm’s way. In other words, if you’re staying in the middle of the freeway, you’re out of a vehicle, cars are going by, there’s a high likelihood, a distinct chance that something else might happen, an another vehicle may hit you. So by ensuring the safety of yourself and others, if you can, move the vehicle out of any harm’s way.

3. Photographs are a good idea, if you get a chance before moving your vehicle, take photographs. All of us have phones now that you can pull out and take photos of pretty much anything, high quality photos. Take a photo of the damage to the vehicle, take a photo of the positions of the vehicle, take photo of the damage to your vehicle, all of these will help in the event there’s a dispute to what actually happened.

4. Calling the police is a good idea, CHP a lot of times in the event there is no major injury they won’t come out, they won’t take a report. So you want to exchange all information with the other party. Most significantly, if there is somebody that saw the accident, comes up to you and says ‘it’s a horrible thing, it’s not your fault’, get that person’s information. It’s crucial. A lot of the times people walk into my office and they take it for granted that the police are going to find that witness, they’re going to get the witnesses information and take a statement, a lot of time that doesn’t happen. If you have a witness, get their name, get their phone number, get that address, you want to follow up with them in the even there’s some dispute as how it actually happened. Other than that, you’ve done all you can at the scene, if you’re injured, go get yourself proper medical care, and if necessary contact personal injury attorney in Sacramento like myself at the Law Office of Fred Sette a Auto Accident Attorney in Sacramento. San Jose Hit-and-Run Collision Kills Two

San Jose authorities are searching for a driver in a suspected hit-and-run accident that occurred early this morning.  The head-on collision killed two women.  Reports indicate that the women were riding in a Toyota Yaris and had taken a left when someone driving a Mercedes sedan slammed into the front of the car.  Just a few minutes earlier police had attempted to pull over the Mercedes sedan after they had seen it driving erratically.   The vehicle drove rapidly through a red light, turning left onto First St., at which point the officers decided not to engage in what they said would have been a risky pursuit on city streets.

If you or a loved one has been injured in any type of car accident – including head-on collisions – it is important to consult with a skilled Sacramento car accident attorney right away.  A knowledgeable car collision attorney can begin an investigation into all of the factors surrounding your case and help ensure you get the compensation you deserve.

The tragic deaths of the two women in this instance was compounded by the fact that the responsible driver fled the scene.    Most states including California require that a driver stop as soon as is safe following an accident.  California Vehicle Code Sec. 20001 provides that any driver regardless of fault must stop after an accident that involves property damage or personal injury and exchange identifying information.   In the event you are not the owner of the car, you must also provide the name and address of the registered owner.

However, despite laws requiring drivers to stop, people may still flee the scene of an accident for a variety of reasons.  Many times, individuals simply panic and don’t know what to do.  They may be scared, but then later contact the authorities to report an accident.  Other times, a hit-and-run accident may be the result of drunk driving.  In these situations a driver may fear arrest and fail to stop, making the situation and potential penalties even worse.  Whatever the motivation, it’s always better to stop than to flee the scene of an accident.

In this instance, the driver fled on foot.  Police continue their investigation.

California Roll Over Accident Leads To The Death Of Two Teens

Sacramento news reports that two California teens died over the weekend as the result of a rollover car crash. According to reports, three teens were riding in a 203 Acura when they approached a roadway curve. The driver could not control the car as he maneuvered around the bend. The car left the roadway, hitting a utility and tree before flipping over. Two passengers were killed, and the driver sustained moderate personal injuries. Alcohol was not considered to be a factor in the car accident.

If you or a loved one has been injured in a car accident, it's important to seek the advice of an experienced Sacramento personal injury lawyer right away. Although the severity of car accidents varies - rollovers are some of the most serious. Rollovers typically occur as the result of drivers trying to over-correct to avoid a roadway hazard, or adjust to the curve of a roadway. However, when a driver maneuvers too quickly he or she may cause the car to flip. This may be a result of driver error, or in some cases roadway design. A roadway design like the angle of a decline, the absence of appropriate barriers or improperly designed shoulders may create a condition that makes rollovers more likely. If an entity designed a road that is unreasonably dangerous, it may be held liable for negligence.

Other times, rollovers occur due to negligence in the manufacture of a car or its parts. This may be due to a defective auto-part or tire manufacturer design. In some cases, the type of vehicle may make it more likely that a vehicle will flip - such as an SUV. Many times, it may be possible to file a negligence lawsuit where the design of a vehicle is unreasonably dangerous or has a defective design or part.

Rollover accidents lead to many different types of injuries including, but not limited to:

 • Neck injuries

 • Head injuries

 • Traumatic brain injuries

 • Broken bones
